“CONSEQUENCE OF THE FALSE DEPOSITION IN AFFIDAVIT”
An affidavit is the declaration made by the person who swears about the genuiness and correctness of the same in the name of God. Rhus the statement made on affidavit is presumed to be true. Any false statement made on affidavit offends the provisions contained in section 191, 193, 199 and 200 0f Indian Penal Code 1860.
Section 191 0f IPC says that if a person makes any statement on oath knowing or be living it to be false, he is said to give false evidence.
Section 193 of IPC provides that any person who intentionally gives false evidence shall be punished with imprisonment of either description for a term which may extend to seven years, and fine.
Section 199 of IPC deals with false statement made in a declaration. It says that if any person makes any statement which he knows of believes to be false, shall be punished in the same manner as if he gave false statement.
Section 200 IPC provides that any person who uses any declaration as true, knowing that it is false, shall be punished in the same manner as if he gave false evidence.
