The Parliament of India passed The Armed Forces Tribunal Act 2007. This led to the formation of Armed Forces Tribunal (AFT) with the power offered for the adjudication or trial by Armed Force Tribunal with regards to Complaints and Disputes with respect to appointments, commission, enrollments and conditions of service with respect of persons subject to The Navy Act, 1957, the Army Act, 1950, and the Air Force Act, 1950. This can further provide for appeals arising out of findings, orders, or sentences of courts, martial held under the said Acts and for matters connected therewith or incidental thereto.
Besides the New Delhi Principal Bench, AFT has Regional Benches at Chennai, Chandigarh, Kolkata, Guwahati, Lucknow, Kochi, Jabalpur, Srinagar, Mumbai and Jaipur.
With the exception of the Lucknow and Chandigarh Regional Benches, which have three benches each, all other places have a single bench. Each Bench comprises of a Judicial Member as well as an Administrative Member.
The Judicial Members are retired Judges of a High Court and Administrative Members are Armed Forces retired Members who have held rant of Major General/ equivalent or above for a three years period or more, Judge Advocate General (JAG), who have held the appointment for at least one year are also entitled to be appointed as the Administrative Member.
The AFT shall transact their proceedings as per the Armed Forces Tribunal (Procedure) rules, 2008. All the proceedings in the Tribunal will be in English language. The AFT will normally follow the procedure as is practiced in the High Courts of India.
The Costume (Dress code) as mandated for the officials of the Armed Force Tribunal including bar will be white shirt, collar band and a black coat/ jacket.
