A guy is deemed innocent in India until proven guilty. According to a proverb, 10 offenders may be cleared, but an innocent person should never be found guilty. In Indian criminal law, the presumption of innocence is a fundamental concept. It is not proper to use the terminology when discussing civil problems because innocence and guilt have to be judged through references to offences or crimes. It has been ruled that the presumption of innocence is a fundamental human right that cannot be overturned. However, it must be used with a few exceptions.
When a lawyer declines to represent a client because others think they are criminals, he or she is engaging in unethical behaviour on the part of the legal profession. An advocate’s professional responsibility under the Advocate Act of 1961 is to represent a criminal defendant, and particular guidelines have been established by the Bar Council of India. According to the rules set forth by the Bar Council of India, “an advocate shall defend a person accused of a crime regardless of his personal view as to the guilt of the accused, having in mind that his devotion is to the law, which mandates that no man be convicted without adequate proof.” As a result, it is the Legal professional and ethical responsibility of the Criminal attorney to take on a client’s case and make an effort to defend him.
